Messy Estates

We’re helping with a deceased estate at the moment.

It’s complicated because the deceased was the trustee of his mother’s estate, and she left a life interest to her brother, who is still alive.

The deceased’s solicitor was meant to help with the appointment of new trustees, but his documents only expressed a wish when they could have actually made the appointment. That might be OK in the end because the wish was to have four trustees, which is rather unwieldy! However, currently there is not trustee at all!

So, we have been engaged to prepare a deed of appointment of new trustees, transfer the property where the brother is living into the names of the trustees and generally advise on what can and cannot be done with the life interest in the trust fund.
