I’ve been helping a lady who wishes to terminate a contract with a builder. The contract provides that the builder needs to be paid for the work that he has done to date. My client wanted me to prepare a document to properly terminate the contract. I immediately asked her to get a building inspector to check the workmanship. Not surprisingly, there are various defects which need to be fixed, or reductions made accordingly. She is now seeking quotes to see how much the cost will be, as she is not keen to let the builder back on site, but unfortunately, she must mitigate her loss and damage by giving him the opportunity to fix the defects.
