I had a chat with another lawyer yesterday about Wills. He has seen my article in the West last year about why kids should pay for their parents’ wills.
He is after wills for himself and his wife. They are both on second marriages and each have kids. They all get along fine now, and they want to leave everything to each other and then the survivor will leave whatever is left of the estate equally between the 5 kids combined.
However, it is possible for the survivor to re-marry, or change their Will, so we will be looking at mutual Wills which will be worded in such a way that they will not be allowed to be revoked without the unanimous consent of the 5 beneficiaries, and also so that a subsequent marriage will not revoke the Wills.
Divorce, however, will be allowed to revoke the Wills.
