Kellie has been working on a breach of confidentiality and trade restraint case this week.
With the help of Steve Edwards, we have found evidence of confidential information being sent to a competitor of our client by an employee, and an attempt to restore the computer to factory settings to cover his tracks, which luckily for us, was unsuccessful.
This person is also colluding to poach staff from our client.
Our client’s employment contract has a liquidated damages clause entitling it to 18% of the poached employee’s salary, but we are also seeking an injunction to restrain any further poaching.
It should be a rather interesting case.
