We have been finalising wills for a couple with a large combined estate, however, the wife will not have much in her estate if she pre-deceases her husband, because most of her assets are in super.
We have worded her will such that, if her husband survives her, even by 5 minutes, all of her super goes to him, tax free, on condition that he gives the gifts that she would like to give to her children and grandchildren.
She could have directed part of her super to go her children, but that would have attracted tax of 15% on any concessional contributions that she had made to the super fund.
Another couple wanted to update their wills. They agreed that wills with full discretionary trusts would likely provide tax benefits to their children’s families in due course.
