We received an e-mail from an old IT client who had a trade mark issue.
A cruise company wanted to register a trade mark in relation to some Apps it had developed. IP Australia said they were too similar to our client’s trade marks, which were in the same class.They asked our client to sign a consent form.
We advised that some descriptions were too broad, and should be amended before consent was given. The company should undertake not to interfere with our clients business, nor seek to register further trade marks in the area without permission. We also included that they should contribute towards his legal fees and some tickets for a nice cruise!
